CONDITIONS OF HIRE OF THE MOTHERS' UNION MEETING ROOMS
IMPORTANT
If the booking is cancelled after we have received confirmation, the cancellation fees shall be paid on or before the date of the proposed event on the following scale:
Less then 14 working days before the event 100% of hire charge
Over 14 working days before the event 30% of hire charge
1. The person named in the application shall be the Hirer and shall be personally responsible for ensuring that these conditions are complied with in all respects.
2. The Trustees of the organisation referred to in the hiring application shall be jointly and individually liable with the Hirer for complying with this agreement.
3. The premises to be hired are part of the premises of The Mothers' Union.
4. THE HIRER AGREES:
a) To pay a deposit of 30% of the hiring charges upon the acceptance of the hiring application by The Mothers' Union.
b) To pay the full hire charge not less than two weeks before the date of hiring.
c) That he or she has inspected the premises and they are suitable for the purposes for which they are hired.
d) To ensure that he or she or some other person authorised in writing by him or her is present throughout the period of hire.
e) To ensure that the responsible person does not leave the premises at the end of the period of hire until the caretaker attends to secure the premises. Note: The Hirer must provide The Mothers' Union, in advance, with a list of those persons who will be responsible during the period of hire.
f) To ensure that the premises are not used for any purpose other than that stated in the hiring application.
g) To ensure that Trustees or staff of The Mothers' Union are allowed access to the premises at all times during the period of hire.
h) To accept full responsibility for and to indemnify The Mothers' Union against all costs, charges and claims in respect of injury to any person using the premises except such as may be caused by the negligence of The Mothers' Union or its staff or agents.
i) To compensate The Mothers' Union for any damage caused during the period of hire or as a result of any breach of this agreement to the building or to any apparatus, chattels or appliances belonging to The Mothers' Union or its staff.
j) To compensate The Mothers' Union or any member of its staff should any theft occur of any items during the period of hire or as a result of a breach of this agreement.
k) To ensure that the fire apparatus on the premises is not interfered with.
l) To ensure that at no time during the period of hire is any emergency exit from the premises locked or obstructed.
m) To ensure that all persons using the premises are aware of the site of fire appliances and emergency exits.
n) To take all proper precautions for the prevention of accidents to any persons on the premises during the period of hire.
o) To provide The Mothers' Union with a list of all persons invited to the function not less than one month before the date of the function (or at such later date as may be agreed).
p) Not to issue tickets or tokens on the premises or in the area of the premises during the period of hire, except with express prior approval.
q) To take proper steps to control admittance to the function and ensure that there is no intrusion or hindrance to any other event or function taking place elsewhere in the House and, in particular, to ensure that in the reception areas and chapel, noise is kept to a minimum so that worship can continue to take place without any undue disruption.
r) To ensure that no music is played on the premises after 11p.m.
s) To ensure that all noise, including music, is kept within the level set by the local authority, details of which can be obtained from the Environmental Health Department
t) To ensure that the activities for which the premises are hired cease in sufficient time before the time stated for completion of the hire in the application form to enable all people to leave the premises and apparatus concerned with the hire to be removed and the premises cleaned and tidied by the time for completion of the hire.
u) To ensure that all facilities used are left in a clean and tidy condition.
v) To ensure that any licenses required for the function, including liquor or music and dancing licenses, are obtained from the relevant authority and that the premises are not used for any activities that require a licence unless the appropriate licence has been obtained and a copy provided to The Mothers' Union, unless prior written agreement has been obtained from The Mothers' Union.
w) That no public announcement of any function proposed to be held shall be made until the application is accepted by The Mothers' Union and the deposit has been paid. The Hirer shall submit to The Mothers' Union not less than one month before the date of the function a draft of any poster, notice, bill, programme, announcement, advertisement, campaign, invitation and/or details of any anticipated press or media attendance (including a copy of all press releases to be issued). The Hirer shall ensure that any press releases issued do not include the words "The Mothers' Union", unless prior written agreement has been obtained from The Mothers' Union.
x) That employees and Trustees of The Mothers' Union are not authorised by The Mothers' Union to assist the Hirer in the organisation of any function held on the premises, unless prior agreement is made, or to accept responsibility for the safe custody of any money or goods.
y) To ensure that the noise level during the arrival or departure of people attending the premises is not such as to cause a nuisance of inconvenience to occupiers of neighbouring propery.
z) Hirers will be responsible for the safety of their own staff and others under their control, and for any injuries caused as a result of their negligence or contravention of current health and safety legislation, whilst on the premises.
5. The Mothers' Union reserves the right of entry of its Trustees, members and staff to the premises at all times during the period of hire.
6. The Mothers' Union shall not be responsible or liable for any damage to or loss of property, articles or objects placed or left on the premises by the Hirer or any other person, or for any loss due to breakdown of machinery, failure to supply electricity or telephone, leakage of water, fire riot restriction or act of God which may cause The Mothers' Union's premises to be temporarily closed or the function interrupted.
7. The Mothers' Union reserves the right to allow the use of other parts of the House during the period of hire and to allow the common use of the entrance hall, toilets and Chapel.
8. The Mothers' Union will provide cleaning materials.
9. The deposit paid on acceptance of the hiring is payable in addition to the hiring charge and shall be held by The Mothers' Union as security for any damage to property belonging to The Mothers' Union during the course of the hiring or any other breach of this agreement.
10. In the event of any breach of the above conditions or in the event of any mis-statement in the form of application or any material omission from the form whenever discovered, the hiring may be cancelled without prior notice in the absolute discretion of The Mothers' Union and any charges paid, including the hiring charge, may be forfeited.
11. If the full hiring charge is not paid as required by condition 4(b) The Mothers' Union may, without prior notice, cancel the hiring and forfeit the deposit unless The Mothers' Union is satisfied in its absolute discretion that there is good reason why the full charges were not paid or unless The Mothers' Union receives another application for hiring covering the same period and suffers no loss of income.
12. The Chief Executive, Deputy Chief Executive and Conference & Facilities Manager of The Mothers' Union have delegated authority from The Mothers' Union Trustees to act on The Mothers' Union's behalf in relation to matters under this agreement.
13. The Mothers' Union reserves the right to cancel this agreement for any good reason beyond its control and in that event to return all fees and deposit paid to the Hirer. In such an event the Hirer shall have no claim against The Mothers' Union for any damage or loss which the Hirer may sustain or have sustained nor in respect of any liability which the Hirer may incur or have incurred in consequence of such cancellation.
14. The Mothers' Union's hiring agreement and these conditions of hire represent the complete contract between the Hirer referred to in the hiring application and The Mothers' Union. No variation of amendment to the conditions shall be valid unless they are in writing signed by an authorised employee or Trustees of The Mothers' Union.
